PRIVACY POLICY

 

INTRODUCTION

This Privacy Policy describes how Maverick Work Wear, Inc. d/b/a Brunt Workwear (“Brunt”, “we”, “us”, “our”) collects, uses, and discloses information collected through the Brunt website at https://www.bruntworkwear.com, and any other website, and subdomains, that we operate (collectively, the “Site”); through other online services available through the Site and our mobile application (collectively, together with the Site, the “Services”); and to information we collect in other ways, including offline (e.g., if you communicate with us in person). 

We handle your information as set forth in this Privacy Policy. By using the Services, you acknowledge the applicability of this Privacy Policy and represent that you have read, acknowledge, and consent to the collection, use and disclosure of your information in accordance with this Privacy Policy. If you do not agree with this Privacy Policy, you should not use the Services. This Privacy Policy does not apply to websites not operated by Brunt.

 

INFORMATION WE COLLECT

  1. Information You Provide.
We may collect any information you provide to us, such as information you enter in a webform on our Services, include in an email, or provide when interacting with customer service. This includes but is not limited to identifying information, such as your name, address, email address, telephone number, billing and shipping addresses; purchase and transaction information, such as the products you purchase and your order history; information about your job such as your industry; and demographic information such as your age range. If you submit financial information through the Services, such as your payment method (valid credit/debit card number, type, expiration date or other financial information), this information is collected and processed by our third-party payment processor, not by us. Limited financial information, such as the last four digits of your payment card number, may be visible to us. If you choose to use certain features of the Services, you may need to provide additional information such as shopping preferences and demographics.

    We may also collect information that you provide to us about other people. If you use our Services to send others a gift card, a product as a gift, information that may interest them or messages (such as invitations) through our Services, we may store your information and the information of each such recipient.

     

    2. Automatically Collected Information.

    We and our third-party vendors may use cookies, pixels, web beacons, server logs, and other similar technologies on our Site to automatically collect information regarding your browser, device, and interactions with our Services when you visit our Site, including but not limited to your IP address, your browser type and language, access times, the content of any undeleted cookies that your browser previously accepted from us, the web pages you visit, the links you click, the searches you conduct on our Site, the referring website address, information you enter into a webform, and the products and amounts of products that you purchase. If you use our mobile applications, this may include information such as geo-location data, device information for the mobile device on which the mobile application is installed and other information in accordance with your device settings. Please consult your device settings if you want to adjust what information can be collected about your device.  

    We also may place web beacons in email messages, newsletters, or SMS messages to determine whether messages have been opened and acted upon.

    We may use and combine information collected via such technologies (including the information collected by our third-party vendors) for analytics, marketing and advertising, to evaluate the success of our advertising campaigns, and as otherwise described in this Privacy Policy. For more information about our use of cookies and other similar technologies and how you can opt out of certain activities, see the “Cookies, Online Analytics, and Tailored Advertising” section below.

    Please note that some vendors may be able to collect information that you enter into a web form on this Site automatically (through cookies, pixels, and similar technology) and prior to your pressing a submit button, as well as other information such as your IP address and email address. Such parties and they may be able to use information from your visits to this Site to send personalized marketing messages.  

     

    3. Information from Other Sources.

    We may collect information about you from our affiliates and from our business partners, contractors and other third parties. If you access the Services using log-in credentials from another website (for example, Google or Facebook), we may collect information from such other website. We may combine information from other sources with any other information we have collected. 

     

    HOW WE USE YOUR INFORMATION

    We may use information we collect for the following purposes:

    • to provide the Services, including to deliver the products and services that you have requested;
    • to communicate with you, including for customer service and to respond to your inquiries;
    • to market and advertise to you, including to send you communications about products or services that may be of interest to you;
    • to process transactions and payments;
    • to enhance your use of the Services, such as through personalization;
    • to conduct research and analysis about our products, services or content, including to analyze and improve the Services; 
    • to maintain security of the Services, detect and respond to security incidents and technical issues;
    • for legal and compliance purposes, including to enforce our legal terms, including this Privacy Policy; to prevent fraud and investigate illegal or potentially illegal activity on the Services; and to exercise and defend our legal rights (including to resolve disputes and collect any fees owed to us); 
    • to protect the safety and/or integrity of our users, employees, other parties, members of the public, and/or our Services; and 
    • for any other lawful purpose, as described to you at the time of collection.

    We may use appropriately aggregated and/or de-identified information for any purpose and disclose such information to any party for any purpose, in our discretion.

     

    DISCLOSING YOUR INFORMATION

    We may disclose the information we collect to the following types of entities and in the following circumstances:

    • Affiliates. We may disclose your information to our corporate affiliates.
    • Vendors. We may disclose your information to vendors that provide services to us, including but not limited to fulfilling orders, processing credit card payments, delivering packages, providing customer service, providing web analytics services, assisting with marketing and advertising activities, performing business and sales analysis, supporting our Site functionality, supporting features offered through our Site, and banking, insurance, auditing, and legal services.
    • Business partners. We may disclose your information to our business partners for purposes such as joint marketing campaigns. 
    • Business transfers. We may transfer or disclose certain information in connection with a proposed or actual merger or sale (including any transfers made as part of an insolvency or bankruptcy proceeding) involving all or part of our business or as part of a corporate reorganization, stock sale, acquisition, or other change in control, or during diligence in contemplation of any of the foregoing.
    • Legal requirements. We may disclose your information if we believe in good faith that doing so is necessary or appropriate to (i) comply with applicable law and any law enforcement, legal, or regulatory process, such as to respond to a subpoena, warrant, or court order; or (ii) protect our legal rights, enforce our Terms of Use or other contractual terms or agreements, or to protect the safety, property, or rights of ourselves or others.
    • With your consent/at your direction. If you consent to the disclosure of your information or direct us to make such disclosure, we may disclose such information consistent with your consent or direction.

     

    DATA SECURITY

    We follow generally accepted industry security measures (including physical, electronic and procedural measures) to help safeguard your information from unauthorized access and disclosure, such as access controls and network security tools. However, no method of transmission over the Internet, or method of electronic storage, is completely secure, so we cannot guarantee complete security of your information. 

     

    YOUR CHOICES

    Account Information. If you have an online account with us, you have the ability to review and update your personal information online by logging into your account. You can also review and update your personal information by contacting us at crew@bruntworkwear.com or by mail to Brunt Workwear, 668 Main Street, Suite 8, Box 131, Wilmington, Massachusetts 01887, USA.

    Marketing Communications. You may choose not to receive marketing emails from us by clicking on the unsubscribe link in the marketing emails. It may take up to 10 days for us to process an opt-out request. If you opt out of marketing emails, we may still send you transactional and relationship emails regarding the Services, such as service announcements and administrative notices.

    You may choose to opt out of receiving marketing communications through our mobile applications notifications and text notifications in the manner identified when you opt in to receive those notifications. 

    Location Data. On your mobile device, you can adjust your settings to change how your location data is accessed and disclosed (check with the manufacturer or your service provider for more details).

    Cookies and Other Similar Technologies. You may adjust your preferences regarding cookies and similar technologies as described below under “Cookies, Online Analytics, and Tailored Advertising.” 

    Limiting Disclosures. We will use reasonable efforts to honor any request that we not disclose your personal information to third parties or our affiliates for direct marketing purposes. You may make such a request by updating your information at bruntworkwear.com or by contacting us by one of the methods in the contact information in the “Contact Us” section below.

    ACCESS TO THE SERVICES FROM OUTSIDE OF THE UNITED STATES

    If you are visiting our Services from outside the United States, please be aware that your information may be transferred to, stored and processed in the United States and other countries where data protection laws may not be as protective as the laws in your country, and data may be accessible to law enforcement and national security authorities under certain circumstances. By using the Services or providing us with any information, you consent to your information being stored in, processed in, and transferred to the United States and other applicable countries.

     

    DATA RETENTION

    We may retain information as long as such information is needed to fulfill the purposes for which it is collected and used as described in this Privacy Policy, and to comply with applicable law. Upon request, information from closed accounts will be deleted as soon as reasonably possibly after the account is closed or deactivated; however, under certain circumstances we may retain information from closed accounts to prevent fraud, collect any fees owed, resolve disputes, troubleshoot problems, assist with any investigation, enforce our Terms of Service, comply with applicable legal data retention obligations, and take other actions permitted by law.

     

    COOKIES, ONLINE ANALYTICS, AND TAILORED ADVERTISING

    1. Cookies and Other Similar Technologies

    As described above, we and our third-party vendors may use cookies, web beacons, pixels, and other similar technologies on our Services and in certain communications to you (e.g., as described above, emails may contain web beacons). Cookies are small text files that are stored on your browser or device. They serve a variety of functions, including enabling the Services to function properly, allowing you to stay logged into your account, personalizing the Services (e.g., remembering your language preferences), helping us analyze use of the Services, and assisting with advertising and marketing. Web beacons and pixels operate in your browser or in your email program and can run operations on your device (such as reading and writing cookies) and can send information from your device to us or third parties. They can help us with various activities, including to track e-mail response rates, identify when our emails are viewed or forwarded, measure or improve the success of our marketing campaigns, and provide information about your device, your actions on the device, and your interactions with the Services. 

    Certain of our third-party vendors may also associate information collected via cookies, pixels, and similar technologies with other information about you, such as your email address or mailing address, for purposes including assisting us with marketing. We may use such information to send you marketing communications via email or direct mail. If you do not want us to collect such information about you, please contact us to opt out using the contact information in the “Contact Us” section below.

    Most browsers automatically accept cookies, but you may be able to modify your browser settings to decline cookies or notify you when a cookie is being set. You may not be able to opt out of “essential” or “strictly necessary” cookies that are necessary for the Services to function. If you choose to decline cookies, you may not be able to sign in or use some of the features offered on our Services, and the Services may not function as intended. If you have multiple devices/browsers or change devices/browsers, or if your browser automatically clears cookies, you will need to disable cookies for each such computer or browser.

    2.Online Analytics

    We may use third-party web analytics services on the Services, such as those of Google Analytics. These vendors use cookies and other similar technologies, as described above, above to help us analyze use of the Services, including by noting the third-party website from which you arrive. The information collected by such technology will be disclosed to or collected directly by these vendors, who use the information to evaluate your use of the Services. To prevent Google Analytics from using your information for analytics, you may install the Google Analytics Opt-out Browser Add-on at https://tools.google.com/dlpage/gaoptout.

    3.Tailored Advertising

    We may allow third parties, including ad networks, ad servers, and other advertising partners, to place cookies or other similar technologies (as described above) on your browser or device to collect information about you to assist in the delivery of relevant advertising on other websites you visit and other online services you use. These ads may be based on your current activity or your activity over time and across other websites and online services and may be tailored to your interests. For example, if you visit our Site, you may see ads for our Site on other websites you visit.

    We neither have access to, nor does this Policy govern, the cookies or other similar technologies that may be placed on the device you use to access the Services by such non-affiliated third parties. If you are interested in more information about tailored browser advertising and how you can generally control cookies from being put on your computer to deliver tailored advertising, you may visit the Digital Advertising Alliance ("DAA") Consumer Choice Page or the Network Advertising Initiative ("NAI") Consumer Opt-Out Page for more information and to opt out of receiving tailored advertising from companies that participate in the DAA and NAI programs. You also may opt-out from Google Analytics for Display Advertising or the Google Display Network by using Google’s Ads Settings.

    Opting out from one or more companies listed on the DAA Consumer Choice Page or the NAI Consumer Opt-Out Page will opt you out from those companies' delivery of interest-based content or ads to you on the browser that you use to perform the opt-out, but it does not mean you will no longer receive any advertising through our Site or on other websites. You may continue to receive advertisements, for example, based on the particular website that you are viewing (i.e., contextually based ads). Also, if you replace, change, upgrade or reset your browser or device, or delete your cookies, or use a browser that automatically clears cookies, you may need to use these opt-out tools again. Additional information is available on the DAA and NAI sites. We do not control the DAA and NAI opt-out mechanisms, nor do we make any representations about the effectiveness or continued availability of these mechanisms.

    4. Do Not Track 

    Do Not Track is a privacy preference that users can set in their browsers. We do not currently recognize or respond to browser-initiated Do Not Track signals, as the Internet industry is currently still working on Do Not Track standards, implementations, and solutions. Please note that Do Not Track is different than the legally recognized browser-based opt-out signals referenced below.

     

    SUPPLEMENTAL NOTICE FOR CALIFORNIA RESIDENTS

    If you are a California resident, the California Consumer Privacy Act, as amended (“CCPA”) requires us to provide you with the additional information provided in this section regarding your “personal information,” as defined in the CCPA. In this section, where we use a term in “quotes,” we are referring to the meaning of that term in the CCPA.

    2. Your CCPA Rights

    If you are a California resident, the CCPA may permit you to request that we:

    • Provide you the categories of personal information we have collected or disclosed about you; the categories of sources of such information; the business or commercial purpose for collecting, “selling,” or “sharing” your personal information; the categories of third parties to whom we disclose or “sell,” or with whom we “share,” personal information; and the categories of personal information we “sell” or “share” (much of which is provided above).
    • Provide access to and/or a copy of certain information we have about you.
    • Delete certain information we have about you.
    • Correct inaccurate personal information that we have about you.

    You may have the right to receive information about the financial incentives that we offer to you, if any. You also have the right to not be discriminated against (as provided for in applicable law) for exercising certain of your rights. 

    Certain information may be exempt from such requests under applicable law. For example, we need certain types of information so that we can provide the Services to you. If you ask us to delete it, you may no longer be able to access or use the Services. Before we respond to your request, you will be required to verify your identity, and we may request additional information from you to verify your identity. To exercise your rights, please send your request (along with your full name, email address, postal address, and the subject line labeled “Your California Privacy Rights”) by email to crew@bruntworkwear.com or by using the "Your Privacy Choices" form here. You may also call us at +1-888-719-6687 to submit your request. If you do not provide this required information, we may not be able to respond to you.

    You also have the right to opt out of “sales” and “sharing” of personal information as described below.

    The CCPA also allows you to limit the use or disclosure of your “sensitive personal information” (as defined in the CCPA) if your “sensitive personal information” is used for certain purposes. Please note that we do not collect “sensitive personal information,” thus we also do not use or disclose it. 

    You can also designate an authorized agent to make a request on your behalf. To do so, you must provide us with written authorization or a power of attorney, signed by you, for the agent to act on your behalf. You will still need to verify your identity directly with us.

    3. “Sales” and “Sharing”

    The CCPA sets forth certain obligations for businesses that “sell” or “share” personal information, as those terms are narrowly defined under the CCPA.

    We may disclose certain personal information to third parties for purposes of analytics and advertising. We provide information to analytics providers to better understand how you use the Services so we can improve the Services and create new products and services. We may also provide personal information to third-party advertising and marketing providers for tailored advertising purposes and marketing, so we can provide you with more relevant and tailored ads regarding our products and services and market our products and services to you. Under the CCPA, disclosing personal information to these third parties may be considered a “sale” of personal information or the “sharing” of personal information for purposes of “cross-context behavioral advertising.” 

    In the 12 months leading up to the effective date of this Privacy Policy, we have “sold” or “shared” (as described above) any of the categories of personal information listed above (except for financial information), to advertising, analytics, and marketing services to assist with such activities. This practice continues today. We may also disclose such information to business partners if, for example, we undertake joint marketing campaigns. We do not “sell” or “share” personal information (as those terms are defined under the CCPA) if we have actual knowledge that the consumer is less than 16 years of age.

    Your browser may also offer a way to activate the Global Privacy Control signal (“GPC”). Our Site treats qualifying browsers for which the user has activated the GPC signal as having opted out of what CCPA calls a “sale” or “sharing” of any California personal information that is collected on the Site from that browser using cookies and similar technology. Any opt out preferences you have exercised through these methods will only apply to the specific device/browser on which you made them. In addition, you can override our treatment for a GPC-enabled browser by clearing your cookies or using a browser that automatically clears cookies.     4. California “Shine the Light” Disclosure

    Under California’s “Shine the Light” law gives residents of California, under California Civil Code § 1798.83, you have the right to opt out of our disclosure of certain categories of “personal information” (as defined in the Shine the Light law) to third parties for their marketing purposes. You may opt out of such disclosures of your personal information by contacting us using one of the contact methods in the “Contact Us” section below (as set forth in the “Your Choices” section above, under “Limiting Disclosures”). 

     

    SUPPLEMENTARY NOTICE FOR RESIDENTS OF OTHER STATES

    Residents of certain other states, such as Virginia, Colorado, and Connecticut, may have certain rights regarding their personal information or personal data, as defined in these states’ laws (collectively, “personal information”).

Please note that we do not engage in profiling that produces legal or similarly significant effects.

    Your state law may permit you to request that we:

    • Confirm whether or not we are processing your personal information and provide you with access such personal information.
    • Correct inaccuracies in your personal information, taking into account the nature of the personal information and the purposes of the processing of the personal information.
    • Delete your personal information.
    • Provide you a copy of personal information that you previously provided to us in a portable and, to the extent technically feasible, readily usable format that allows you to transmit the data to another business, where our processing is carried out by automated means.
    • Opt you out of the processing of the personal information for purposes of targeted advertising, the sale of personal information, or profiling in furtherance of decisions that produce legal or similarly significant effects concerning you (as described below).

    Certain information may be exempt from such requests under applicable law. For example, we need certain types of information so that we can provide the Services to you. If you ask us to delete it, you may no longer be able to access or use the Services.
